Terms of Use

These Terms explain the rules for using Open Pi, including its Raspberry Pi management features and Pro access options on iOS and Android.

Plain-English summary: Open Pi helps you manage equipment you control. It is not a safety-critical service. Pro is available through platform-specific one-time purchases, and Android may also offer an automatically renewing monthly subscription. Your statutory consumer rights are not limited by these Terms.

1. Agreement to these Terms

These Terms of Use ("Terms") form an agreement between you and FOP Svitelskyi Artem ("Open Pi", "we", "us", or "our") for the Open Pi app, related website, and any Open Pi Agent component you choose to install (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use Open Pi for an organization, you confirm that you have authority to accept these Terms for that organization. You must be old enough to enter into a binding agreement where you live. The Service is not directed to children under 13.

2. The Service and your license

Open Pi is a tool for connecting to, monitoring, and managing Raspberry Pi devices and services that you own or are authorized to administer. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for its intended purpose.

You may use the iOS app only on Apple-branded products that you own or control and as permitted by the applicable Apple Media Services Terms and Apple usage rules. You may use the Android app on compatible devices under the Google Play Terms of Service and applicable Google Play usage rules. We may update, modify, suspend, or discontinue features when reasonably necessary for security, reliability, legal compliance, or product improvement.

3. Features, connectivity, and optional software

The Service can display device metrics, services, containers, files, terminal output, GPIO state, processes, and alerts. Some features require SSH, a local network, internet access, notification permissions, an installed Open Pi Agent, or a compatible third-party service. Features can vary by platform, operating system, device, region, and your Raspberry Pi configuration.

Open Pi Agent and optional tools are installed on your Raspberry Pi only when you expressly choose an installation or update. You remain responsible for your Raspberry Pi, network, credentials, backups, firewall rules, operating system, containers, and any third-party software. Review and comply with third-party terms and licenses before using them.

4. Free access, trial, and Pro access

Open Pi may offer a limited free tier. Where offered, an eligible new user may explicitly start one 72-hour full-access trial. The trial starts only after you choose it and our licensing service confirms eligibility. It is not a store subscription, requires no payment method for the trial itself, and does not auto-renew.

iOS Lifetime

One-time, non-consumable in-app purchase for one Apple Account. The App Store price shown at purchase controls.

iOS Lifetime Family

One-time, non-consumable purchase supporting Apple Family Sharing where Apple makes that benefit available.

Android Monthly Subscription

Automatically renews each month until canceled. Google Play shows the localized price and billing terms before purchase.

Android Lifetime Access

One-time, non-consumable purchase for the Google Account used in Google Play. It does not auto-renew.

Prices, currency, taxes, availability, renewal terms, and purchase conditions are shown by Apple or Google and may vary by storefront. Monthly subscription pricing can change only with the notice, consent, and cancellation rights required by Google Play and applicable law. We do not receive or store your payment card details.

After a trial ends, access may return to the free tier unless you obtain Pro access. Trial eligibility is tied to a privacy-protective licensing identity and server time so it cannot be reset by reinstalling or changing the device clock. Previously verified access may continue for a limited offline period; a fresh install or monthly subscription can require a connection to the relevant store to verify current access.

5. Purchases, restoration, refunds, and revocation

iOS purchases are processed by Apple. Use the same Apple Account and the in-app Restore Purchases action to restore a qualifying non-consumable purchase. Apple controls payment processing, receipts, refunds, and Family Sharing availability. A purchase may be unavailable if Apple reports it as refunded, revoked, or no longer shared with you.

Android purchases are processed by Google Play. The in-app Restore Purchases action asks Google Play for active subscriptions and owned one-time products associated with the current Google Account. Monthly subscribers can manage or cancel through the in-app Manage subscription action or the Google Play subscriptions center. Cancellation normally takes effect at the end of the current paid period unless Google Play or applicable law provides otherwise.

Where Apple permits it, we grant Lifetime Single access to legitimate historical paid-download customers when a verified production App Store record shows a qualifying pre-migration purchase and no revocation. This is an access migration, not a separate transferable in-app purchase. A paid-download refund or other revocation does not qualify for that migration. The migration is subject to Apple’s verified record and does not affect mandatory rights you may have under applicable law.

For refund requests, use the purchase support process of Apple or Google Play unless applicable law requires a different process. We cannot override a store’s payment, refund, subscription, account, or sharing decisions.

6. Additional store terms

For the iOS app, these Terms supplement the Apple Standard EULA and the Apple Media Services Terms. If an Apple term conflicts with these Terms for an App Store matter, the applicable Apple term controls.

For the Android app, these Terms supplement the Google Play Terms of Service and Google Play purchase terms. If a Google Play term conflicts with these Terms for a Play transaction or subscription matter, the applicable Google Play term controls.

7. Your responsibilities and acceptable use

You must use Open Pi only with systems, accounts, networks, and data that you are authorized to access. Keep credentials secure, use strong authentication, maintain backups, and verify the effect of any command before running it.

You must not: bypass access controls; reverse engineer or interfere with the Service except where law cannot prohibit it; use the Service to harm, disrupt, scan, or access another person’s systems without authorization; transmit malware; violate law or third-party rights; or use the Service in a way that could create unreasonable risk to people, property, or critical infrastructure.

8. Your data and privacy

You retain ownership of your Raspberry Pi data and content. You give us only the limited permission needed to process data for the features you choose to use. Our collection and handling of personal information is described in the Privacy Policy. Do not place highly sensitive information in terminal commands, filenames, alerts, or support messages unless necessary.

9. Intellectual property

Open Pi, its software, design, documentation, and branding are protected by applicable intellectual-property laws. Except for the limited license above, these Terms do not give you ownership of the Service or our intellectual property. Third-party software and trademarks remain the property of their respective owners.

10. Important disclaimers

Open Pi is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy.

The Service can execute or assist with actions that affect your devices. Network delays, credentials, system updates, hardware faults, commands, third-party services, and configuration errors can produce unexpected results. Do not rely on Open Pi as the sole means of monitoring, protecting, or controlling safety-critical, medical, emergency, industrial, financial, or life-support systems.

11. Limitation of liability

To the maximum extent permitted by law, Open Pi and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business interruption arising from use of the Service. Our total liability for a claim relating to the Service will not exceed the amount you paid to Open Pi for the Service in the 12 months before the event giving rise to the claim, or USD $10 if you paid nothing. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.

12. Indemnity

To the extent permitted by law, you will defend and indemnify Open Pi and its developer against claims, losses, and expenses arising from your unauthorized use of the Service, breach of these Terms, or violation of another person’s rights. This does not apply where applicable law does not permit it.

13. Changes and termination

We may change these Terms when features, laws, or security needs change. Material changes will be posted here with an updated effective date. Continuing to use the Service after the effective date means you accept the updated Terms, unless law requires a different process. You may stop using the Service at any time. We may suspend or terminate access for a material breach, fraud, abuse, or legal/security reason.

14. Governing law and consumer rights

These Terms are governed by the laws that apply to the developer’s business, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your country gives you greater protection. Nothing in these Terms removes rights that cannot be waived under applicable law.
